Sections 19-03.1-05 and 19-03.1-11. Outside any narrow exception described below, state law does not authorize general adult possession, sale, manufacture, or personal cultivation.

North Dakota’s controlled-substance law names psilocybin and psilocyn, not spores as such. The current fifty-state survey identifies California, Florida, Georgia, and Idaho as the states with specific restrictions on spores capable of producing psilocybin mushrooms. Published chemical analysis detected no tryptamines in P. cubensis basidiospores.
