Religious Protections

Arkansas Religious Freedom Restoration Act 975

Arkansas has its own Religious Freedom Restoration Act, known as Act 975, passed in 2015. This law is designed to protect individuals’ religious freedoms by ensuring that the government does not substantially burden a person’s exercise of religion unless it is in furtherance of a compelling governmental interest and is the least restrictive means of achieving that interest. This state law closely aligns with the federal RFRA enacted in 1993.

Arkansas State Constitution – Article 2, Section 24

Arkansas Constitution also provides protections for religious freedom. Article 2, Section 24 states: “All men have a natural and indefeasible right to worship Almighty God according to the dictates of their own consciences; no man can, of right, be compelled to attend, erect, or support any place of worship, or to maintain any ministry against his consent; no human authority can, in any case or manner whatsoever, control or interfere with the right of conscience; and no preference shall ever be given, by law, to any religious establishment, denomination, or mode of worship, above any other”.

Key Court Cases

Albert Krantz v. City of Fort Smith (1998): This case, heard by the Eighth Circuit Court of Appeals, involved the distribution of religious leaflets. The court ruled that ordinances prohibiting such activities violated the First Amendment, thus affirming religious freedom rights.

State Magic Mushroom Laws

Both psilocybin and psilocyn are currently considered a Schedule I substance in Arkansas.

(d) Hallucinogenic substances: Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation, which contains any quantity of the following hallucinogenic substance, or which contains any of its salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation (for purposes of this paragraph only, the term “isomer” includes the optical, position and geometric isomers):
