Colorado has taken a bold step towards psilocybin mushrooms, becoming one of the first states to decriminalize them. Voters passed Proposition 122 in November 2022, legalizing possession, use, and personal cultivation for adults 21 and over.
This means individuals can legally possess and consume psilocybin mushrooms within their private residences. There are no set quantity limits outlined in the law. Interestingly, the proposition also allows adults to share psilocybin with each other, as long as everyone involved is 21 or older. However, selling psilocybin remains illegal.
It’s important to note that this decriminalization only applies at the state level. Psilocybin is still a Schedule I controlled substance under federal law, so possessing it could still lead to federal charges. Additionally, public consumption of psilocybin mushrooms is still against the law in Colorado.
