The laws in Georgia regarding psilocybe cubensis spores are strict compared to most other states. Even though spores don’t contain psilocybin, a psychoactive compound, until they are cultivated, Georgia law makes it illegal to possess, sell, or purchase these spores.
This is aimed at preventing the cultivation of psilocybin mushrooms, which are considered a Schedule I controlled substance. Because of these regulations, Lord of Spore Magic Mushroom Spores are not for sale in Georgia.
Georgia’s state constitution addresses religious freedom in Article I, Section I, Paragraph IV. It ensures that no resident will be molested or penalized in person or property for their religious beliefs. It explicitly states that no person shall be barred from holding public office due to their religious opinions. However, it also clarifies that the right to religious freedom does not excuse acts that are licentious or practices that are inconsistent with the peace and safety of the state.

Ulike most other states, Georgia Code § 16-13-1 (627) classifies mushroom spores as “dangerous drugs” because, when mature, they contain the psychoactive compounds psilocybin or psilocin. As a result, it is illegal to possess, sell, or purchase these spores in the state. This makes Georgia one of the few states in the U.S. with such stringent regulations on mushroom spores. The law states:
“(b) In addition to subsection (a) of this Code section, a “dangerous drug” means any other drug or substance declared by the General Assembly to be a dangerous drug; to include any of the following drugs, chemicals, or substances; salts, isomers, esters, ethers, or derivatives of such drugs, chemicals, or substances which have essentially the same pharmacological action; all other salts, isomers, esters, ethers, and compounds of such drugs, chemicals, or substances unless specifically exempted and the following devices, identified as “dangerous drugs”:
…
(627) Mushroom spores which, when mature, contain either psilocybin or psilocin;”

(3) Any material, compound, mixture, or preparation which contains any quantity of the following hallucinogenic substances, their salts, isomers (whether optical, position, or geometrics), and salts of isomers, unless specifically excepted, whenever the existence of these salts, isomers, and salts of isomers is possible within the specific chemical designation:

(N) Psilocybin;
(O) Psilocyn (Psilocin);
