California currently classifies psilocybin and psilocyn as Schedule I under Cal. Health & Safety Code Section 11054. Outside any narrow exception described below, state law does not authorize general adult possession, sale, manufacture, or personal cultivation.

Are Psilocybe Cubensis Spores Legal In California?
California Health and Safety Code Sections 11390 through 11392 specifically regulate spores and mycelium capable of producing mushrooms containing psilocybin or psilocyn. Section 11390 prohibits cultivation with intent to produce the controlled substance; Section 11391 prohibits transport, import, sale, furnishing, or giving away such material for the purpose of facilitating a Section 11390 violation. Section 11392 provides a narrow approved-research exception.

Does California Have A Religious Protection Act?
California does not have a generally applicable state RFRA in the 2026 state-law dataset. Religious exercise remains protected by the United States and California constitutions, but federal RFRA generally governs federal rather than state or local government action.
