Religious Protections

While Delaware does not have its own Religious Freedom Restoration Act (RFRA), it does include protections for religious freedom in its state constitution.

Delaware Constitution, Article I, Section 1:

“Although it is the duty of all persons frequently to assemble together for the public worship of Almighty God; and piety and morality, on which the prosperity of communities depends, are hereby promoted; yet no person shall or ought to be compelled to attend any religious worship, to contribute to the erection or support of any place of worship, or to the maintenance of any ministry against his consent; and all persons professing the Christian religion ought forever to enjoy equal rights and privileges in this state, unless, under color of religion, any man disturb the public peace, or obstruct others in their religious worship; and all persons who also profess to believe in Jesus Christ the Savior of the world shall be capable of holding any office, exercising any place of trust or profit in this state.”
