State By State Guide To Magic Mushroom Laws

The mycelium and the fruiting bodies of magic mushrooms are typically banned because they contain Psilocybin, and Psilocin – the active ingredients that make people hallucinate.

Magic mushroom spores DO NOT CONTAIN Psilocybin, Psilocin, or any other hallucinogenic substances, so most states do not ban them. And they can be purchased to use for research, or microscopy.

Alabama

The Alabama Religious Freedom Amendment (Amendment 622) was ratified to ensure that the freedom of religion is not burdened by state and local law. It mandates that the government should not burden a person’s freedom of religion unless there is a compelling governmental interest, and such burdening is the least restrictive means of furthering that interest. This amendment is broader than federal protections, as it does not specify the need for a “substantial burden” to invoke its protections, meaning that any burden on religious exercise could potentially be contested under ARFA.

The Eleventh Circuit Court has acknowledged Alabama’s strong protection of religious exercise, indicating that the state’s laws may provide more extensive religious protections compared to federal law. In practical terms, this could mean that religious practices involving entheogens could be more defensible in Alabama, provided they are part of a sincere religious belief and practice.

Alaska

Alaska’s constitution strongly supports the freedom to practice religion, possibly offering more protection than the federal law.  However, Alaska does not have its own Religious Freedom Restoration Act (RFRA), meaning there is no specific state-level statute that provides additional safeguards for religious practices like the use of entheogens. This means that, while the state recognizes religious freedom, there may be fewer legal precedents to support such defenses in state courts.

The state’s broad laws aimed at preventing discrimination don’t offer clear exceptions for religious practices. This could make it difficult for religious groups that want to use entheogens as part of their rituals. Despite these challenges, Alaska’s strong constitutional support for religious freedom might still offer some level of defense for such practices. Advocates in Alaska would need to rely on the general principle of religious freedom in the state constitution to support the case for using entheogens in religious activities

Arizona

Arizona has its own version of the RFRA, enacted in 1999, codified in Ariz. Rev. Stat. §41-1493.01. This act requires that the government must have a compelling interest to substantially burden an individual’s exercise of religion and that such burdening must be the least restrictive means of furthering that compelling governmental interest.

While Arizona’s RFRA does not specifically address entheogens, the framework it provides can potentially protect religious practices involving entheogens. This protection, however, would depend on the entheogenic practice being recognized as a legitimate religious exercise.

Arkansas

Arkansa’s Religious Freedom Restoration Act (RFRA), Act 975 was enacted in 2015. This law states that the government must not substantially burden an individual’s freedom of religion unless it is necessary to further a compelling governmental interest, and if so, it must do this in the least restrictive way possible.

While Arkansas’s RFRA does not directly address the use of entheogens, it sets a legal precedent that could be used to argue for the religious use of entheogens, provided that such use is part of a sincere religious practice and does not harm others. However, the application of this law to entheogens would depend on court interpretations and decisions in specific cases.

California

California has not enacted its own version of the Religious Freedom Restoration Act (RFRA), and its legal framework includes nondiscrimination laws that may conflict with the beliefs of many religious organizations​. The state constitution aligns with the federal First Amendment, providing basic protections for free exercise of religion but not extending beyond these minimum requirements.

The absence of a state RFRA in California means there is no additional state-level statutory protection that could be directly applicable to the religious use of entheogens. This could potentially make it more challenging to argue for the religious use of entheogens based solely on religious freedom grounds within the state.

Missouri

Article I, Section 5 of the Missouri Constitution upholds religious freedom, stating that all individuals have the “natural and indefeasible right to worship Almighty God according to the dictates of their own consciences” and that no law shall control or interfere with this right. Missouri’s Religious Freedom Restoration Act (RFRA): Similar to the federal RFRA, Missouri’s RFRA, enacted in 2003, requires the state to demonstrate a compelling interest before it can infringe upon an individual’s free exercise of religion. This law could provide a basis for legal defense in cases involving the religious use of entheogens.

Missouri has not specifically legislated on entheogens and currently has drug laws that classify psychedelics, including psilocybin, as controlled substances. However, the state’s strong protection of religious freedom provides a potential defense for religious use of entheogens, albeit untested in significant court cases.
